The 1bios website, web apps, mobile apps, 1bios provided devices, and other information services (the “Service” or “Services”) are made available by 1bios, Inc. (“1bios,” "we," "our," or "us") subject to these terms and conditions, including those set forth in this Privacy Policy (the “Terms”). By accessing the Services, whether as a healthcare provider, an authorized staff member, a patient, or other end user, you agree to follow and be bound by the Terms. We may make changes to our Services, these Terms of Service, and our Privacy Policy at any time. Your continued use of our Services constitutes acceptance of such changes.
Definitions
You may be eligible to use our Services if you are a Customer or if your Health Partner has instructed us to provide you with the Services. You must register before using our Services. During registration, you agree to provide accurate and complete information and to promptly update it as necessary. You are responsible for maintaining the confidentiality of your account credentials. If you are using the Services on behalf of an organization, you represent and warrant that you are authorized to do so.
You agree to access and use the Services in accordance with these Terms. If you are an End User, this means use for your personal, non-commercial purposes. If you are a Customer or authorized representative, your use must be in accordance with your Agreement with 1bios.
You agree not to misuse the Services. Prohibited conduct includes, but is not limited to, attempting to access others' accounts, uploading malware, reverse-engineering our code, using automated systems to extract data, and engaging in illegal or unauthorized use of the Services. Use of our Service must comply with all applicable laws and regulations.
All content and software associated with the Services are owned by or licensed to 1bios and protected under copyright and other intellectual property laws. You are granted no ownership rights or licenses except as expressly provided.
Our Services may contain links to external websites or resources. We are not responsible for their availability, content, or practices.
We may monitor the Services in accordance with this Privacy Policy to ensure functionality and security, and to improve user experience.
Use of the Services involves inherent risks. You assume full responsibility for your use of the Services and agree to release and indemnify 1bios and its affiliates from any related liability, to the extent allowed by law.
The Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service or outcomes. Use of the Services does not constitute medical advice and does not create a provider-patient relationship with 1bios.
Your sole and exclusive remedy for dissatisfaction with the Services is to stop using them.
To the maximum extent permitted by law, 1bios disclaims liability for indirect, incidental, consequential, or punitive damages resulting from the use of the Services.
You agree to indemnify 1bios against claims arising from your use of the Services, your violation of these Terms, or your infringement of any rights.
We may suspend or terminate access to the Services for any reason, including non-compliance with these Terms or the termination of a Customer agreement. Provisions intended to survive termination shall do so.
These Terms are governed by the laws of the State of California, U.S., without regard to conflict of law principles. Access from locations where the Services are illegal is prohibited.
If any part of these Terms is unenforceable, the remainder shall remain in effect. These Terms constitute the entire agreement between you and 1bios regarding the Services.

We collect information to determine eligibility, provide Services, and tailor your experience. This may include name, gender, health habits (e.g., activity, nutrition), and biometrics (e.g., heart rate, blood pressure).
We provide digital health tools that vary by program and Health Partner. Services may include device connections, tracking health data, setting goals, receiving alerts, and sharing data with authorized parties.

Your Health Partner: May share your contact or health information.
Cookies/IP: For personalization and session management.
For Customers (e.g., healthcare providers), we collect business contact details, organizational information, and usage data for service delivery and improvement. We do not use Customer data for marketing.

With Your Health Partner, in accordance with HIPAA and applicable law
With authorized business partners under contract
With insurers and providers as necessary for treatment, payment, or health care operations

We do not share your data with employers for employment purposes. We do not sell your information or use it for advertising.
We comply with HIPAA and enter into Business Associate Agreements with Customers when required by law.
We use administrative, physical, and technical safeguards including encryption, role-based access, monitoring, and training to protect your data. SSL technology secures your data during internet transmission.
You may access and correct personal data through the Services. You may request account deactivation via the Contact section.
If 1bios makes material changes to any terms or conditions of this Privacy Policy, such changes will be reflected within the Services, and notification of such changes will be posted within the Services and other places 1bios deems appropriate, so that you stay aware of any material changes in what information 1bios collects, how 1bios uses it, and under what circumstances, if any, 1bios discloses it. 1bios reserves the right to modify this Privacy Policy at any time, so please review it frequently. The date of the most recent update will be posted at the beginning and end of this Privacy Policy. Continued use of the Services constitutes acceptance of changes.
